Contract of carriage by sea translation

A contract of carriage by sea governs the transportation of goods by sea and the transport charge (freight). In practice, it operates together with the bill of lading, booking confirmation and conditions of carriage; its translation is needed in disputes, insurance compensation and customs files.

The cargo description, loading and discharge ports, freight and additional charges (dead freight, demurrage), and liability clauses require particular care in translation. Established Turkish terminology in transport law is used; consistency with other documents in the chain (bill of lading, insurance policy) is maintained.

Which institutions request this document?

  • Courts and arbitral tribunals
  • Cargo insurers — in claims and compensation files
  • Customs authorities
  • Legal departments of exporting and importing companies

Certification requirements

Is notarisation required?

Notarization is required for copies submitted to judicial authorities; a sworn translation is sufficient for commercial assessment.

Is an apostille required?

It is not required for the contract; for copies bearing foreign official certification, the chain is planned on a file-by-file basis.

There is no universal rule. The institution requesting the document determines its certification requirements. The information above describes common practice. Tell us which institution you are applying to and we will help clarify the required certification.

Preparing your document

  • Send the relevant bill of lading and correspondence with the contract; the complete context clarifies terminology choices
  • If you know which clauses are disputed, specify them; they can be supported with translator's notes
  • Specify the authority and country where the document will be used

Frequently asked questions

Are a bill of lading and a contract of carriage by sea the same document?

No. The contract of carriage establishes the transport relationship; the bill of lading is a negotiable document evidencing receipt of the cargo and representing title to it. They are usually translated together in case files.

Can only the relevant clauses be translated?

This is possible for internal company review; however, judicial authorities generally require the entire document. If a partial translation is made, this is clearly stated on the translation.
